Pengertian Konstitusi

1. Pengertian Konstitusi Menurut Beberapa Ahli :

• K.C. Wheare, konstitusi ialah sistem ketatanegaraan suatu negara berupa kumpulan peraturan yang mengatur pemerintahan suatu negara.

• Koernimanto Soetopawiro, konstitusi berasal dari bahasa latin yaitu “cisme” yang berarti bersama dengan dan “statute” yang berarti memuat sesuatu agar berdiri. Jadi konstitusi berarti menetapkan secara bersama.

• L.j Van Apeldoorn, konstitusi memuat baik peraturan tertulis maupun peraturan tak tertulis.

• Lasalle, konstitusi adalah hubungan antara kekuasaaan yang terdapat di dalam masyarakat seperti golongan yang mempunyai kedudukan nyata di dalam masyarakat misalnya kepala negara angkatan perang, partai politik.

2. Dalam perkembangannya konstitusi mempunyai 2 pengartian, yaitu :

• Pengertian dalam arti luas: Keseluruhan dari ketentuan-ketentuan dasar atau hukum dasar (Droit Cnstitunelle) baik tertulis maupun tidak tertulis maupun campuran 2 unsur tersebut.

• . Pengertian dalam arti sempit: Piagam dasar atau UUD (Loi Cnstitunelle) yaitu suatu dokumen lengkap mengenai peraturan-peraturan dasar negara.

Jadi bisa disimpulkan pengertian konstitusi adalah sistem ketatanegaraan yang berupa peraturan baik tertulis maupun tidak tertulis yang ditetapkan bersama untuk mengatur pemerintahan suatu negara.
